Terms of Service

By downloading or using Hoops49 ("the app"), you agree to be bound by these Terms of Service. If you do not agree, please do not use the app.

1. Use of the App

Hoops49 is an NBA statistics, predictions and tracking application for personal, non-commercial use only. You may not: use the app for any unlawful purpose; reverse-engineer, decompile, or extract source code; scrape, harvest, or redistribute the data displayed; or use automated tools to access the app or its backend services.

2. Accounts

You must create an account to use the app. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately at support@hoops49.com if you suspect unauthorized access. We reserve the right to suspend or terminate accounts that violate these Terms.

3. Subscriptions (Hoops49 PRO)

Certain features require an active Hoops49 PRO subscription, purchased through Google Play Billing (Android) or Apple StoreKit (iOS).

Android — Google Play Billing

• Fees are billed in advance on a recurring basis (monthly or annual) as selected at purchase.
• Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current period.
• Manage or cancel anytime via your Google Play account settings. Refunds follow Google Play's refund policy.

iOS — Apple StoreKit (auto-renewing subscriptions)

• Payment is charged to your Apple ID at confirmation of purchase.
• The subscription auto-renews unless auto-renew is turned off at least 24 hours before the end of the current period; your account is charged within 24 hours prior to renewal.
• Manage and cancel in your Apple ID account settings. Any unused portion of a free trial (if offered) is forfeited on purchase. Refunds follow Apple's refund policy.

4. Data Accuracy

NBA data displayed in the app — including player statistics, averages, rankings, standings, schedules and scores, injury status, confirmed lineups, salary and contract figures, advanced statistics, betting odds, and projections — is sourced from third-party providers. We do not guarantee the accuracy, completeness, or timeliness of any data.

• Injury status, confirmed lineups, and contract data are subject to provider delays and may not reflect the latest team announcements.
• Projections and AI-generated insights are predictive estimates from statistical and machine-learning models. They are not advice of any kind and carry no guarantee of accuracy.
• Betting odds and player props are reproduced for informational purposes only and are not affiliated with any sportsbook.

Do not rely on any data displayed in the app for gambling, wagering, fantasy-sports lineup decisions, medical decisions, or any financial decision. Always verify with the original source before acting on any information shown.

5. Intellectual Property

The app's source code, design, original artwork, and machine-learning models are the property of Floppyspot unless otherwise noted.

NBA team names, logos, trademarks, player names, statistics, and related marks are the property of the NBA, its member teams, and the NBPA. Hoops49 is an independent application and is not affiliated with, endorsed by, sponsored by, or officially connected to the NBA, the NBPA, any NBA team, or any NBA player. Team logos are used solely for nominative identification alongside publicly reported statistics and schedule information. The app does not display, transmit, or store any player photographs or likenesses.

DMCA / Copyright Takedown

If you believe content in the app infringes your copyright, send a notice including identification of the work and the allegedly infringing material, your contact information, a good-faith statement, a statement under penalty of perjury that you are authorized to act, and your signature, to support@hoops49.com (subject: "DMCA Notice").

6. Disclaimer of Warranties

The app is provided "as is" without warranties of any kind, express or implied. We do not warrant that the app will be uninterrupted, error-free, or free of harmful components. Your use of the app is at your sole risk.

7. Limitation of Liability

To the maximum extent permitted by law, Floppyspot shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the app.

8. Termination

We reserve the right to suspend or terminate your access to the app at any time, with or without cause or notice. Upon termination, your right to use the app immediately ceases.

9. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date above reflects any changes. Continued use after changes are posted constitutes acceptance.

10. Governing Law

These Terms are governed by the laws of Croatia, without regard to conflict-of-law provisions. Disputes are subject to the exclusive jurisdiction of the courts of Croatia.

11. No Betting Facilitation

Hoops49 is an informational sports-analytics product. We do not:

• Accept, place, hold, or transmit wagers on your behalf.
• Hold or process gambling funds.
• Guarantee the accuracy of any projection, line, or expected value.
• Act as a sportsbook, exchange, broker, or licensee of any gambling jurisdiction.

If you place a bet at a third-party sportsbook based on Hoops49 information, you do so entirely at your own risk and under the laws of your jurisdiction.

12. Jurisdictional Limitations & Minimum Age

Hoops49 is intended only for individuals in jurisdictions where viewing sports-betting-adjacent informational content is legal. You are responsible for confirming the legality of your use in your location, and must discontinue use where any feature is prohibited.

You must be 18 years of age or older to use Hoops49. By confirming "Yes, I'm 18 or older" you represent that you are at least 18. Misrepresenting your age immediately terminates your right to use the app.
