Terms of Service

By downloading or using Hoops49 ("the app"), you agree to be bound by these Terms of Service. If you do not agree, please do not use the app.

1. Minimum Age

You must be 18 years of age or older to use Hoops49. By tapping "Yes, I'm 18 or older" on the age confirmation screen, you represent and warrant that you are at least 18 years old. If you misrepresent your age, your right to use Hoops49 is immediately terminated and we may delete your account.

2. Use of the App

Hoops49 is an NBA statistics, predictions and tracking application for personal, non-commercial use only. You may not: use the app for any unlawful purpose; reverse-engineer, decompile, or extract source code; scrape, harvest, or redistribute the data displayed; or use automated tools to access the app or its backend services.

3. Accounts

You may use Hoops49 as a guest, in which case an anonymous account is created for you, or you may create a full account with an email address. If you create a full account, you are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately at support@hoops49.com if you suspect unauthorized access. We reserve the right to suspend or terminate accounts that violate these Terms.

4. Subscriptions (Hoops49 PRO)

Certain features require an active Hoops49 PRO subscription, purchased through Google Play Billing (Android) or Apple StoreKit (iOS).

Android — Google Play Billing

• Fees are billed in advance on a recurring basis (monthly or annual) as selected at purchase.
• Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current period.
• Manage or cancel anytime via your Google Play account settings. Refunds follow Google Play's refund policy.

iOS — Apple StoreKit (auto-renewing subscriptions)

• Payment is charged to your Apple ID at confirmation of purchase.
• The subscription auto-renews unless auto-renew is turned off at least 24 hours before the end of the current period; your account is charged within 24 hours prior to renewal.
• Manage and cancel in your Apple ID account settings. Any unused portion of a free trial (if offered) is forfeited on purchase. Refunds follow Apple's refund policy.

5. Data Accuracy

NBA data displayed in the app — including player statistics, averages, rankings, standings, schedules and scores, injury status, confirmed lineups, salary and contract figures, advanced statistics, betting odds, and projections — is sourced from third-party providers. We do not guarantee the accuracy, completeness, or timeliness of any data.

• Injury status, confirmed lineups, and contract data are subject to provider delays and may not reflect the latest team announcements.
• Projections and AI-generated insights are predictive estimates from statistical and machine-learning models. They are not advice of any kind and carry no guarantee of accuracy.
• Betting odds and player props are reproduced for informational purposes only and are not affiliated with any sportsbook.

Do not rely on any data displayed in the app for gambling, wagering, fantasy-sports lineup decisions, medical decisions, or any financial decision. Always verify with the original source before acting on any information shown.

Model performance and profit

Hoops49 publishes measures of how its models have performed — hit rates, calibration curves, expected value, and closing-line value. Those figures are historical. They describe games that have already been played, over a limited sample, under the conditions in which they were measured. They are not a prediction of future results.

We do not guarantee that using Hoops49 will be profitable, and we make no representation that any projection, edge, expected-value figure, or model verdict will produce a winning bet. Betting carries a real risk of losing money, up to and including the entire amount you stake.

A positive expected-value figure is an estimate produced by a model from imperfect and sometimes delayed data — not a promise of return. Model accuracy varies by market, changes over time, and can be worse in live use than in testing. Markets labeled BETA in the app have not yet had their accuracy confirmed on live results.

Any wager you place is your own decision, made at your own risk, with your own money. Never stake money you cannot afford to lose.

6. Intellectual Property

The app's source code, design, original artwork, and machine-learning models are the property of Floppyspot j.d.o.o. unless otherwise noted.

NBA team names, logos, trademarks, player names, statistics, and related marks are the property of the NBA, its member teams, and the NBPA. Hoops49 is an independent application and is not affiliated with, endorsed by, sponsored by, or officially connected to the NBA, the NBPA, any NBA team, or any NBA player. Team names are used descriptively alongside publicly reported statistics and schedule information. Team badges shown in the app are our own design — the club's colours and its three-letter abbreviation — and no team logos are used. The app does not display, transmit, or store any player photographs or likenesses.

DMCA / Copyright Takedown

If you believe content in the app infringes your copyright, send a notice including identification of the work and the allegedly infringing material, your contact information, a good-faith statement, a statement under penalty of perjury that you are authorized to act, and your signature, to support@hoops49.com (subject: "DMCA Notice").

7. Disclaimers and Statutory Warranties

Hoops49 provides sports information, statistical analysis, projections and other informational content. Predictions, projections, probabilities, odds comparisons and other outputs may be incomplete, delayed, inaccurate or affected by events outside our control. Past performance does not guarantee future results.

To the maximum extent permitted by applicable law, Hoops49 and the Services are provided on an "as is" and "as available" basis. We do not guarantee that the Services will always be available, uninterrupted, error-free, secure or suitable for any particular purpose, or that any prediction, projection or analysis will be accurate.

Nothing in these Terms excludes, restricts or modifies any statutory warranty, legal guarantee of conformity, consumer right or remedy that cannot lawfully be excluded, restricted or modified under applicable law.

Where applicable law provides you with mandatory consumer rights or statutory guarantees, those rights and guarantees remain fully applicable.

8. Limitation of Liability

To the maximum extent permitted by law, Floppyspot j.d.o.o. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the app.

9. Termination

We reserve the right to suspend or terminate your access to the app at any time, with or without cause or notice. Upon termination, your right to use the app immediately ceases.

10. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date above reflects any changes. Continued use after changes are posted constitutes acceptance.

11. Governing Law and Jurisdiction

These Terms are governed by the laws of the Republic of Croatia, without regard to its conflict-of-law principles.

If you are a consumer, this choice of law does not deprive you of any mandatory protections granted to you under the laws of the country or state in which you reside. You may bring a claim before any court having jurisdiction under applicable consumer-protection law, including, where applicable, the courts of your place of residence.

If you use the Services for business or professional purposes, the courts competent for our registered seat in the Republic of Croatia shall have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Services.

Nothing in these Terms limits any rights or remedies that cannot lawfully be limited or excluded.

12. No Betting Facilitation

Hoops49 is an informational sports-analytics product. We do not:

• Accept, place, hold, or transmit wagers on your behalf.
• Hold or process gambling funds.
• Guarantee the accuracy of any projection, line, or expected value, or that acting on any of them will be profitable.
• Act as a sportsbook, exchange, broker, or licensee of any gambling jurisdiction.

If you choose to place a bet at a third-party sportsbook based on Hoops49 information, you do so entirely at your own risk and under the laws of your own jurisdiction.

Sportsbook names and trademarks. All sportsbook names, logos and trademarks are the property of their respective owners. We display them solely to identify the source of a price and to allow comparison between operators. Hoops49 is not affiliated with, endorsed by, or sponsored by any sportsbook or wagering operator.

Odds accuracy. Odds are supplied by a third-party data provider and are shown for informational and comparison purposes only. They may be delayed, incomplete or inaccurate, and they may differ from the price the sportsbook is actually offering at the moment you look. Verify current odds directly with the relevant sportsbook before relying on them.

13. Jurisdictional Limitations

Hoops49 is intended for use only by individuals located in jurisdictions where viewing sports-betting-adjacent informational content is legal. You are responsible for confirming the legality of your use of Hoops49 in your specific location. We make no representation that Hoops49 is appropriate for use in any particular jurisdiction.

If you access Hoops49 from a location where any of its features are prohibited by local law, you agree to discontinue use immediately.

15. Additional Terms for Users Who Download the App from Apple's App Store

The following terms apply if you download or use Hoops49 through Apple's App Store. If these terms conflict with another provision of these Terms, these terms will apply solely with respect to your use of the iOS version of Hoops49.

15.1 Acknowledgement

These Terms are concluded between you and Floppyspot jednostavno društvo s ograničenom odgovornošću za izdavanje softwarea (short name Floppyspot j.d.o.o.; "Company," "we," "us," or "our"), and not between you and Apple Inc. ("Apple"). The Company, not Apple, is solely responsible for Hoops49 and its content.

Your use of Hoops49 must comply with the applicable usage rules set out in the Apple Media Services Terms and Conditions.

15.2 Scope of License

Subject to these Terms, the Company grants you a limited, personal, non-exclusive, non-transferable and revocable license to use Hoops49 on Apple-branded products that you own or control, as permitted by the usage rules contained in the Apple Media Services Terms and Conditions.

Hoops49 may also be accessed and used by other accounts associated with you through Apple Family Sharing or volume purchasing where permitted by Apple.

15.3 Maintenance and Support

The Company is solely responsible for providing maintenance and support for Hoops49 as required under these Terms or applicable law. Apple has no obligation to provide maintenance or support services for Hoops49.

15.4 Warranties

The Company is solely responsible for any warranties relating to Hoops49, whether expressly provided or implied by applicable law, to the extent such warranties cannot lawfully be excluded.

If Hoops49 fails to conform to an applicable warranty, you may notify Apple, and Apple may refund the purchase price, if any, paid for the Licensed Application. To the maximum extent permitted by applicable law, Apple has no other warranty obligation concerning Hoops49.

The Company is responsible for any other claims, losses, liabilities, damages, costs or expenses attributable to a failure of Hoops49 to conform to an applicable warranty, subject to the limitations permitted under these Terms and applicable law.

Nothing in these Terms excludes or limits any warranty, consumer right or remedy that cannot lawfully be excluded or limited.

15.5 Product Claims

The Company, not Apple, is responsible for addressing claims made by you or a third party relating to Hoops49 or your possession or use of Hoops49, including:

• product-liability claims;
• claims that Hoops49 fails to comply with an applicable legal or regulatory requirement; and
• claims arising under consumer-protection, privacy or similar legislation.

15.6 Intellectual Property Claims

If a third party claims that Hoops49, or your possession or use of Hoops49, infringes that party's intellectual-property rights, The Company, not Apple, will be responsible for investigating, defending, settling and resolving that claim.

15.7 Legal Compliance

You represent and warrant that:

• you are not located in a country or territory subject to a United States Government embargo or designated by the United States Government as a country supporting terrorism; and
• you are not included on any United States Government list of prohibited or restricted parties.

15.8 Developer Information

15.9 Third-Party Terms

When using Hoops49, you must comply with all applicable third-party terms, including the terms applicable to your device, internet or mobile-data service, Apple Account and any third-party services that you choose to use in connection with Hoops49.

15.10 Apple as Third-Party Beneficiary

You acknowledge and agree that Apple and its subsidiaries are third-party beneficiaries of these Terms as they relate to your use of Hoops49 through the App Store. Upon your acceptance of these Terms, Apple will have the right, and will be deemed to have accepted the right, to enforce these App Store provisions against you as a third-party beneficiary.
